The Estate Planning Information Blog: Single? You Still Need an ...


Many people believe that if they are single, they don't need a will and other estate planning documents. However, estate planning is just as important for single people as it is for couples and families.

Estate planning allows you to ensure that your property will go to the people you want, in the way you want, and when you want. If you do not have an estate plan, the state will decide who gets your property and who will make decisions for you should you become incapacitated. An estate plan can also help you save on estate taxes and on court costs for your loved ones.

The most basic estate planning document is a will. If you do not have a will directing who will inherit your assets, your estate will be distributed according to state law. If you are single, most states provide that your estate will go to your children or to other living relatives if you don't have children. If you have absolutely no living relatives, then your estate will go to the state. You may not want to leave your entire estate to relatives -- you may have close friends or charities that you feel should get something. Without a will, you have no way of directing where your property goes.

Many single people have significant others, perhaps with whom they live. ?Unfortunately, without a will, it is unlikely that any of your?estate?will benefit your significant other, even if you live together. ?Moreover, your significant other may lose important real or personal property, creating great hardship. ?At a minimum a simple will can resolve some of these issues.

If you are single and have a child, you may be initially comforted by the fact that your estate benefits your child upon your passing. ?What may concern you, however, ?is that without an estate plan, you can't be sure who manages the estate you leave to your children. ?Often, the determination of who manages your estate makes a difference in whether the assets are best managed for the benefit of your child. ??

The next most important document is a durable power of attorney. A power of attorney allows a person you appoint -- your "attorney-in-fact" or "agent" -- to act in your place for financial purposes when and if you ever become incapacitated. In that case, the person you choose will be able to step in and take care of your financial affairs. Without a durable power of attorney, no one can represent you unless a court appoints a conservator or guardian. That court process takes time, costs money, and the judge may not choose the person you would prefer.

In addition, you should have a health care proxy. Similar to a power of attorney, a health care proxy allows an individual to appoint someone else to act as their agent, but for medical, as opposed to financial, decisions. Unlike married individuals, unmarried partners or friends usually can't make decisions for each other without signed authorization.

If you are planning to give away a lot of your money, there are ways to do that efficiently through the annual gift tax exclusion and charitable remainder trusts. Other estate planning documents to consider are a revocable living trust and a living will.

Samsung to get a look at Apple's settlement with HTC

Samsung will be able to look at the settlement between Apple and HTC. Samsung will reportedly use the content of the settlement to determine if they need to halt sales of any of their products after their billion-dollar loss to Apple in a US court in August. Apple had previously sought to keep the specific dollar amount of its settlement with HTC private while providing the rest of the settlement terms for Samsung to view, though Samsung didn?t find this sufficient. Bryan Bishop of The Verge reports:

Apple's attorneys had previously agreed to share a version of the agreement that redacted the financial terms of the settlement; in a hearing today Samsung argued that the fees HTC is paying Apple indicate how much consumer demand there is for those features covered by the patents. While Judge Grewal did write that he was "more than a little skeptical" of Samsung's argument, he nevertheless ordered Apple to turn over the document.

Samsung feels that if Apple is licensing patents to HTC, then Apple is fine with someone using the intellectual property covered by those patents as long as they are paid for its use. Since Apple will be recieving a settlement from Samsung based on August?s verdict, Samsung believes that an injunction is unjustified. Whether this will be enough to satisfy the court is up for debate, because licensing agreements typically involve a contract to use intellectual property, and while Samsung will indeed pay Apple a large sum of money, they still used the intellectual property without permission in the eyes of the law, having made no contract with Apple on the use of their intellectual property. The hearing for a possible injunction against Samsung?s products will being on December 6th.

Baxter in talks to buy Gambro for about $4 billion

(Reuters) - Baxter International Inc is in talks to buy Swedish medical-equipment maker Gambro for about $4 billion, according to a source familiar with the situation.

A deal is seen in the next 2 to 3 weeks but has not been finalized yet, so it could still fall apart, the source said on Friday.

Baxter and Gambro could not be reached for comment.

Gambro is owned by two Nordic private-equity firms. Investor AB, which owns 49 percent, declined to comment; EQT, which owns 51 percent, was not immediately available.

Baxter, based in suburban Chicago, manufactures kidney dialysis equipment, drug infusion pumps and blood therapy products. Acquiring Gambro would boost Baxter's renal business, which currently generates almost one-fifth of Baxter's revenue.

Baxter's dialysis machines perform a form of dialysis called peritoneal, which can be performed at home. Gambro is one of the largest makers of equipment for hemodialysis, which is generally performed in a hospital or clinic.

Baxter posted sales of $13.89 billion in 2011. It had $3.19 billion in cash at the end of the third quarter.

Carbon target not in Energy Bill

The government has published details of its long-awaited Energy Bill, designed to keep lights on and emissions down.

The government will provide ?7.6bn towards low-carbon electricity infrastructure by 2020, but household bills are set to rise to pay for it.

A decision about setting carbon emission targets for 2030 has been delayed until 2016, after the election.

Labour said this was a "humiliating failure" by the Lib Dems, who want gas banished from the electricity system.

Environmentalists also condemned the bill, saying it would make it very hard to meet the UK's law on climate change.

Details of the bill were announced late on Thursday although the bill itself will not be published until next week.

Crudely speaking, the bill has been a battleground between Chancellor George Osborne, who favours gas-powered generation, and the Liberal Democrats, who want clean energy.

The chancellor is adamant that gas will help keep down power bills in the future. He and the Treasury want flexibility in energy choices.

But the Lib Dems want to banish gas from the electricity system almost entirely by 2030 to reduce CO2 emissions in line with the Climate Change Act, although gas will be needed as a back-up.

They say this will also keep power bills down overall by reducing the UK's exposure to volatile gas prices in a power-hungry world.

Lost the battle

On-going uncertainty over energy strategy has infuriated the firms that are expected to invest more than ?100bn to renew the UK's decaying energy infrastructure by 2020.

This decision runs counter to the resolution at the Lib Dem party conference.

As part of the negotiations, the chancellor has agreed to fund clean energy until 2020, almost matching the amount the advisory committee on climate change said would be needed to meet emissions targets (?8bn in 2020).

The committee estimated that that amount would add about ?110 a year to household energy bills by 2020.

"This is a durable agreement across the coalition against which companies can invest and support jobs and our economic recovery," said Energy and Climate Change Secretary Ed Davey.

"The decisions we've reached are true to the Coalition Agreement. They mean we can introduce the Energy Bill next week and have essential electricity market reforms up and running by 2014 as planned."

But Labour criticised the government's failure to set an emissions target for electricity for 2030.

'Bill derailed'

Environmental groups have also criticised the government's announcement.

"By failing to agree to any carbon target for the power sector until after the next election, David Cameron has allowed a militant tendency within his own ranks to derail the Energy Bill," said John Sauven, executive director of Greenpeace.

"It's a blatant assault on the greening of the UK economy that leaves consumers vulnerable to rising gas prices, and sends billions of pounds of clean-tech investment to our economic rivals."

But Energy UK, which represents the energy industry, welcomed the measures.

"This agreement is good news and we look forward to seeing the details of the bill," said Angela Knight, chief executive of Energy UK.

"We are pleased to see that the levy control framework means that the UK will be building new power stations, including nuclear and renewables. This is a huge investment and must bring forward the jobs and economic growth that the UK needs."

But in contemplating the subject on a deeper level, I realized there are many financial lessons parents don?t necessarily share ? not because they are too private but since questions like his can be unusual and the subject doesn?t necessarily come up.

HE used to be his parents' brave little soldier but now Kieran Webster, who is battling brain cancer, has a new nickname ? Mr Incredible.

For the past 81 weeks, the three-year-old has been in and out of London's Great Ormond Street Hospital (GOSH), receiving regular chemotherapy to reduce the size of the tumour that has been growing inside his brain.

However, on December 10, a fortnight before his fourth birthday on Christmas Eve, his chemo will come to an end, thus bringing a difficult chapter in his life and that of his family to a close.

Besides the drugs, Kieran has gone under the knife four times since he was diagnosed with optic pathway glioma in April 2011.

It is likely he will require radiotherapy treatment in the future, yet for his parents Emily and Steve, this Christmas will undoubtedly be one to celebrate after the trials and tribulations of the past 20 months.

Mrs Webster, 28, of Trinity Road, Billericay, told the Gazette: "Kieran is just amazing the way he bounces back after his treatment.

"He has been so strong and so brave throughout the whole process and we are now looking forward to being able to get some normality back in our lives."

In September, Kieran began attending Little Achievers Montessori Pre-School in Church Street, Great Burstead and, as his mum explained, he's having a whale of a time.

Mrs Webster, a part-time HR advisor, said: "He has a special friend at pre-school called Poppy and when he was last in hospital the children there rang him to ask when he was going to come back to pre-school and play with the tractor outside."

The mum-of-two added: "We used to call him our brave little soldier but now he is Mr Incredible because less than a week after he had his latest surgery in October he requested to go back to pre-school."

Meanwhile dad Steve, a 28-year-old warranty adviser at Aston Martin Brentwood, said: "Kieran has suffered problems with his sight as a result of the tumour but his sense of hearing in particular appears to have improved significantly in order to compensate for his visual impairment.

"He will hear my phone go or an email notification on the computer before we ever do," said Mrs Webster, who also has a one-year-old son called Blake.

"He relies on his hearing and as a result it is regularly monitored to make sure the chemotherapy drugs don't have an adverse effect."

Since Kieran was first diagnosed, there has been no shortage of people prepared to help him and his family however they can.

Indeed, a community fundraising event held at the Knights Way Centre in Brentwood in September 2011 raised an impressive ?4,000 for GOSH.

Mrs Webster said: "Lots of people have made the situation a lot easier to deal with from helping us with washing, cooking and taking Blake off our hands.

"We also want to thank everyone who donated to GOSH at our fundraiser ? we are eternally grateful."

Oil prices ease as Gaza truce holds

(AP) ? Oil prices extended their falls Friday as a cease-fire agreement between Israel and the militant Hamas group that stopped weeklong fighting in the Gaza Strip continued to hold.

Benchmark crude for January delivery was down 28 cents to $87.10 per barrel at midday in London in electronic trading on the New York Mercantile Exchange. The contract rose 63 cents to finish at $87.38 per barrel Wednesday. Markets were closed Thursday for the U.S. Thanksgiving holiday.

Israel launched an offensive on Nov. 14 to halt rocket fire from Gaza, unleashing some 1,500 airstrikes on Hamas-linked targets, while Hamas and other Gaza militants showered Israel with just as many rockets. A truce reached Wednesday was still intact, easing fears of an escalating war that could spill beyond Gaza and eventually disrupt oil supplies.

"I think it's a bit of reaction to the cease-fire in the Middle East, said Ric Spooner, chief market analyst at CMC Markets in Sydney.

Brent crude, used to price international varieties of oil, fell 33 cents to $110.53 a barrel in London.

In other energy futures trading in New York:

? Heating oil fell 2 cents to $3.06 a gallon.

? Wholesale gasoline rose 4 cents to $2.75 a gallon.

? Natural gas was steady to $4.02 per 1,000 cubic feet.

Political reporter Pat Warren explains Baltimore expects a new micro loan fund to benefit entire neighborhoods.

In the world of fashion, Jody Davis wears a lot of hats. She joined the mayor and other small business-owners Wednesday morning for the launch of a city micro loan fund, money available to Baltimore-based businesses with annual revenues of under a million dollars.

?The economics makes it really a challenge and this product that they?re coming out with for micro loans would help a person like myself just propel forward,? Davis said.

And as small businesses go, so goes the city.

?They create a buzz that attracts people, not just from that community and from the city but a buzz throughout the region and we want to happen in more Baltimore neighborhoods,? said Mayor Stephanie Rawlings-Blake.

The micro loans are between $5,000 and $30,000.

?Growing a business not just helps myself, it helps the economy in general,? said Davis.

Baltimore small businesses get another plug from the mayor this weekend on her Small Business Saturday tour, which follows Black Friday.

Loan applications will be accepted starting December 17.

Mursi draws fire with new Egypt decree

CAIRO (Reuters) - Egyptian President Mohamed Mursi triggered controversy on Thursday by issuing a decree likely to lead to retrials of Hosni Mubarak and his aides but which was compared to the ousted leader's autocratic ways.

As well as ordering retrials for Mubarak-era officials responsible for violence during the uprising against his rule, the decree shielded from legal challenge an Islamist-dominated assembly writing Egypt's new constitution.

It gave the same protection to the upper house of parliament, dominated by Islamists allied to Mursi, and assigned the president new powers that allowed him to sack the Mubarak-era prosecutor general and appoint a new one.

It stated that all decisions taken by Mursi until the election of a new parliament were exempt from legal challenge.

Presented as a move to "protect the revolution", the decree won immediate praise from Mursi's allies but stoked fears among secular-minded Egyptians that the Muslim Brotherhood and its allies aim to dominate the new Egypt. It seemed likely to deepen the divisions that have plagued the post-Mubarak era.

"These decisions will feed discord in Egyptian politics and will be far from creating a favourable climate for restoration of economic growth," Mustapha Kamal Al-Sayyid, a professor of political science at Cairo University, said.

Leading liberal politician Mohamed ElBaradei, writing on his Twitter account, said Mursi had "usurped all state powers and appointed himself Egypt's new pharaoh". But Mahmoud Ghozlan, spokesman for the Brotherhood, described the move as "revolutionary and popular".

The decree appeared to remove any uncertainty still hanging over the fate of the assembly writing the constitution. The body has faced a raft of legal challenges from plaintiffs who dispute its legality.

Critics say its popular legitimacy had been further called into doubt by withdrawals of many of its non-Islamist members who had complained their voices were not being heard.

The constitution is a crucial element in Egypt's transition to democracy. New parliamentary elections will not be held until the document is completed and passed by a popular referendum.

The decree also gave the body an additional two months to complete its work, meaning the drafting process could stretch until February, pushing back new elections.

The move to order a retrial of Mubarak-era officials will likely be popular among those who feel that revolutionary justice has yet to be served.

Mubarak, 84, was sentenced to life in prison in June for failing to prevent killings that occurred during the uprising that led to his February 11, 2011 downfall. He has been held in a prison hospital since his sentence was handed down.

Yet critics have faulted the process by which he and other officials were put on trial. One of the problems, they say, was that the Mubarak-era prosecutor general had not been replaced.

Mursi had tried to replace Abdel Maguid Mahmoud, the man sacked on Thursday, in October. The move kicked up a storm of protest from judges who said the president had exceeded his powers and was threatening their independence.

Mursi got around the problem this time by giving himself the power to appoint a new prosecutor general, Talat Abdullah, whose swearing-in was shown on state television.

Heba Morayef, Egypt director for Human Rights Watch, said: "Egypt needed judicial reform and the public prosecutor is a Mubarak holdover, but granting the president absolute power and immunity is not the way to do it."

Common perspectives on marriage have changed throughout the course of history time and time again. Marriage is very much an institution constructed by societal beliefs and values during that period of time.

In the 1980s, the average age for an American woman to marry for the first time was 22. Thirty years later, the average age for a first marriage jumped to 26 for women and 28 for men.

While this jump in age worries many people, there are others who strongly believe that marrying at an older and more mature age benefits a marriage significantly.?There are two primary factors involved with marrying young that put the couples who embark on this adventure at an immediate disadvantage.

Financial stress:

One of the biggest stressors put on a married couple (and any individual in this economy) is finances. Financial woes can put an undue amount of stress on any relationship young or old, married or unmarried.

However, young married couples are far more likely to encounter such woes than individuals who marry at an older age when they are in a more comfortable and stable financial situation.

As young adults still in or just out of college, you are faced with fewer opportunities to stabilize your economic lives. Paying off student loans, entering the ?real world? for the first time, and scouring to find your first real job may not be the best environment to try to cultivate a marriage in. This is not to say that young married couples can?t survive these challenges.

Some may even argue that conquering these financial obstacles with your partner when you are both young can only strengthen your bond. While this is entirely possible, it is also entirely possible that the unnecessary stresses created by young marriage and early financial uncertainty will be detrimental to a union.

Emotional factors:

Several emotional factors play into marrying at a young age as well. While financial instability is a concrete number that an individual can point to as an issue, emotional growth is somewhat more difficult to define.

Studies indicate that most people reach a state of mental maturity at around 25 years old. Prior to reaching this point, we tend to make our decisions primarily based on emotion and instinct rather than on logic or reasoning. For this reason,?marrying at a young age?can be difficult.

Many individuals between the ages of 18 and 24 are simply unprepared for the emotional challenges and compromise that marriage requires. Sometimes, couples who marry young will grow and mature together. However, many will also grow separately and in different directions.

By no fault of the relationship or any single partner, a union will strain as each member matures and begins to learn new things about themselves and their partner.

Of course, the success or failure of a marriage and relationship is not dependent on any universal factor. Each relationship is unique and each couple manages challenges differently. As people continue to stay unmarried later into life, perspectives on marriage continue to change and fluctuate.

Marriage is a beautiful and cherished experience full of challenges and learning. Take this important step in life when you and your partner feel truly prepared for the adventure. When deciding whether to marry at a young age, consider the financial and emotional issues and implications that accompany your decision.

The key strategy to maintaining a successful marriage young or old is entering the union with realistic expectations.

Wray Herbert: The Shame of the Alcoholic

This month in Cleveland a woman was caught swerving her car onto a sidewalk, illegally passing a school bus full of children. A judge sentenced her to stand on the street corner wearing a sign that read, "Only an idiot would drive around a school bus." In Arlington, Tex., a billboard features mug shots of suspected johns, with the words, "This could be you." Arlington is one of many American communities going out of their way to publicly humiliate men who buy sex, while other towns are similarly targeting shoplifters and drunk drivers. And it's not just judges; parents around the country are also forcing their kids to wear signs -- "I am a thief," for example -- to shame them into moral action.

America has a long tradition of public humiliation, dating back to stockades and pillories of the colonial era. But this recent upsurge in the use of scorn and shame is raising important questions about this practice, namely: Does it work? Does shame really motivate people to change? Or does it work the opposite way, further tarnishing people's self-image and diminishing their sense of personal responsibility?

And how about addiction? Does the same psychological dynamic work with socially undesirable habits like drug use and alcoholism? Shame and addiction are deeply intertwined. Alcoholics may be prone to shame, by disposition, and on top of that, drinking helps numb these aversive feelings. Indeed, alcoholics may drink in part to cope with chronic shame and low self-worth, and the heavy drinking could in turn be causing shame, creating a vicious cycle of abuse.

These complex questions have never been sorted out scientifically -- until now. Two psychological scientists at the University of British Columbia -- Jessica Tracy and Daniel Randles -- decided to see if alcoholics' feelings of shame about their addictions might actually interfere with their attempts to get sober. They recruited about a hundred middle-aged men and women from the rooms of Alcoholics Anonymous, all with less than six months of sobriety. They measured their levels of shame and other emotions, along with personality traits, and then about four months later they brought them back into the lab to see how they were doing in recovery.

One reason shame has gone unstudied is that it is a very difficult emotion to capture. People who are experiencing shame tend to hide the feeling and escape it, not talk about it openly. For this reason Tracy and Randles came up with a novel way to measure shame and assess its effect on behavior: body language. They asked the volunteers to describe the last time they drank "and felt badly about it" and videotaped their responses. Then, later, they analyzed and coded their body movements and postures as a measure of their shameful feelings. People who are ashamed act very much like submissive animals, slumping the shoulders and narrowing the chest, the opposite of proud chest beating. This physical display of shame may be universal: It has been observed in a range of species, and in both adults and children of many cultures.

The scientists wanted to see if shameful body language correlated with mental and physical health, and especially with successful sobriety, four months later. This is the time window during which most newly recovered alcoholics will relapse, and indeed more than half the volunteers never made it back to the lab. But with those who did, there was an unmistakable connection between shame and relapse. The alcoholics who were most ashamed about their last drink -- typically a humiliating experience -- were much more likely to relapse. Their relapses were also more severe, involving much more drinking, and they were more likely to suffer other declines in health. In short, as described in a future issue of the journal Clinical Psychological Science, feelings of shame do not appear to promote sobriety or protect against future problematic drinking -- indeed the opposite.

This is the first scientific evidence to bolster what alcoholism counselors and recovering alcoholics have long known: Shame is a core emotion underlying chronic heavy drinking. Shame is what gets people into the rooms of AA -- it defines the alcoholic "bottom" -- but it's a lousy motivator for staying in recovery. The power of AA is that it offers something to replace the negative emotions that most alcoholics know all too intimately.

Austin, Scandrick hurt for Cowboys vs. Redskins

(AP) ? Cowboys receiver Miles Austin and cornerback Orlando Scandrick left Thursday's game against Washington due to injuries.

Austin strained his right hip and Scandrick hurt his left hand. The Cowboys said after halftime that neither player would return.

Austin came down hard in the back of the end zone on the opening drive of the game when he took a hit from linebacker London Fletcher on an incomplete pass. Austin also had been knocked to the ground by Fletcher after an earlier incomplete pass.

Dallas was already without receiver Kevin Ogletree, who was inactive because of a concussion sustained Sunday.

Scandrick was hurt when he was trying to make a tackle and was hit by teammate Anthony Spencer. Scandrick ran straight to the sideline holding his arm.

The team initially said Scandrick was being evaluated for a forearm injury.
